WellNow Urgent Care has agreed to a $1.1 million class action settlement to resolve allegations stemming from a cybersecurity breach on April 25, 2023. The breach affected 597,000 individuals and exposed sensitive data, including names, health information, and in many cases, Social Security numbers.
Plaintiffs allege that WellNow failed to implement and maintain reasonable data protection protocols, which allowed unauthorized access to confidential patient information. As a result, impacted individuals faced risks such as identity theft, fraud, and privacy violations.
WellNow operates urgent care clinics across New York, Ohio, Illinois, and Michigan. Though the company denies any wrongdoing, it agreed to the settlement to resolve the claims.
Class members fall into one of two groups:
Non-SSN Class Members: May claim up to $7,500 for documented out-of-pocket expenses like credit monitoring, professional fees, and identity protection. They can also claim up to 2 hours of lost time at $25 per hour.
SSN Class Members: Also eligible for up to $7,500 for documented expenses. Additionally, they can claim up to 3 hours of lost time. Those who do not seek reimbursement may instead claim a pro rata cash payment based on their inclusion in the SSN group.
All payments are subject to documentation and may vary depending on the number of claims submitted.
