Gerber Formula Class Action Settlement

Consumers who purchased Gerber Good Start Gentle infant formula in Florida or New York between October 10, 2011, and April 23, 2016.

Required for higher payouts. Acceptable documentation includes receipts, invoices, or payment records showing product name, date, price, and quantity. Proof of residency in Florida or New York during the class period is also required.

Gerber Products Co. has agreed to a multi-million dollar settlement resolving claims that its Gerber Good Start Gentle infant formula was falsely advertised as reducing the risk of allergies.

According to the lawsuit, Gerber marketed the formula as allergy-reducing without scientific proof. The plaintiffs say this marketing misled parents into paying a premium for formula they believed offered unique health benefits.

Gerber did not admit to any wrongdoing but chose to settle to resolve the dispute.

Under the Terms of the Settlement

Class members can receive cash payments depending on where they purchased the formula and how many units they bought:

• Without proof of purchase:

  • Florida residents: $3 per unit for up to 5 units (max $15)

  • New York residents: $4 per unit for up to 5 units (max $20)

• With proof of purchase:

  • Florida residents: $3 per unit for up to 20 units (max $60)

  • New York residents: $4 per unit for up to 20 units (max $80)

Payments will be distributed after final approval and may be adjusted based on the number of valid claims filed.
