Who's eligible?

Consumers who purchased non-organic eggs from Alderfer Poultry Farm between Dec. 1, 2020, and the date of the court’s final approval order, for personal or household use.

Proof of Purchase

Not required to file a claim. Without proof, you may claim up to two cartons. With proof (e.g., receipts, shipping confirmations, invoices), you may claim unlimited cartons.

Alderfer Family Farm and Alderfer Poultry Farm agreed to a $287,500 class action settlement following allegations that they falsely advertised their non-organic eggs as coming from free-roaming hens.

According to the lawsuit, Alderfer promoted its eggs as coming from hens that roam freely, when the hens were allegedly kept in cages. The plaintiffs say they relied on these marketing claims and paid a premium price, only to later learn the conditions contradicted the packaging.

The farm, based in Pennsylvania, supplies eggs to retailers and grocery chains. While Alderfer denies wrongdoing, it agreed to the settlement to resolve the dispute and avoid ongoing litigation.

Under the Terms of the Settlement

Class members can receive:

  • $2 per carton for each qualifying purchase

  • This may increase to $3 per carton depending on how many claims are submitted

  • Claims without proof of purchase are capped at two cartons

  • Claims with proof of purchase are unlimited

The lawsuit follows similar challenges to egg labeling practices by other brands such as Eggland’s Best, Kroger, and Nellie’s Free Range Eggs.
